The materials available at HomeSaleForms.com contain all of the information, directions and documents needed to understand and co-ordinate the purchase or sale of residential real property in each of the several states.
The following are the various categories of materials provided:
Required Sales Documents
The required sales documents are the bare essentials needed by state and/or federal law to complete the real estate sale. After completion by one or both parties, the original (or a copy thereof, where permitted) are normally provided to the Escrow Agent to guide its activity and to substantiate performance of all obligations by the parties.
Unless otherwise noted as not required for a particular state, these documents normally are the following:
- Purchase Agreement,
- Seller's Property Condition Disclosure Form, and
- Disclosure of Information on Lead-Based Paint and/or
Lead-Based Paint Hazards.
All have been tailored to the specific needs of each jurisdiction, and are currently in compliance with the code provisions of each state.
Recommended Sales Documents
The recommended sales documents are those not currently required by state and/or federal law, but which nonetheless provide additional disclosures regarding the property.
Unless otherwise noted as required for a particular state, these documents normally are the following:
- Carbon Monoxide (CO) Detector Disclosure Form,
- Point of Sale Inspection Disclosure Form,
- Radon Gas Disclosure Form, and
- Smoke Detector Disclosure Form.
These additional disclosures serve the critical function of allowing the Buyer to acquire even greater knowledge of the property's condition and affording the Seller addition protection from liability for potential defects not otherwise addressed by the required disclosure forms. Their use is strongly suggested.
Publications
The following pamphlets published by the United States Environmental Protection Agency (U.S. EPA) are included for reference and use:
- Protect Your Family From Lead in Your Home
(U.S. EPA Publication EPA 747-K94-001), and
- Home Buyer's and Seller's Guide to Radon
(U.S. EPA Publication EPA 402-R93-003).
The first, Protect Your Family From Lead in Your Home, must be provided to the Buyer by federal law and most state laws, along with the lead-based paint disclosure form which is a required document. It is advisable to provide the second, Home Buyer's and Seller's Guide to Radon, to the Buyer as well, at the time that the recommended radon disclosure form is given.
